Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") governs your use of the cloud infrastructure, virtual private servers (VPS), Electronic Direct Mail (EDM) systems, managed networks, and all related digital IT services provided by GoGeeks Pty Limited, including our related bodies corporate, affiliates, contractors, and agents ("GoGeeks", "we", "us", or "our").


By accessing or using our infrastructure and services, you agree to comply strictly with this AUP. If you do not agree, you must immediately cease using our services.

1. General Prohibitions


You may only use our services for lawful purposes. You are strictly prohibited from using GoGeeks infrastructure to transmit, distribute, or store material that:

  • Violates any applicable local, state, federal, or international laws and regulations.
  • Promotes, encourages, or engages in illegal activities, terrorism, or violence.
  • Infringes upon the intellectual property rights of others (e.g., distributing pirated software, movies, or music).
  • Is defamatory, harassing, abusive, obscene, or fraudulent.

2. Network Security & Abuse


To protect the integrity of our network and the security of all clients sharing our infrastructure, you must not engage in any activity that compromises system security. Prohibited activities include:

  • Hacking & Unauthorised Access: Attempting to access systems, servers, or networks without explicit authorisation.
  • Denial of Service (DoS/DDoS): Launching or facilitating attacks designed to overload or disable external or internal networks.
  • Malicious Code: Hosting, distributing, or executing viruses, malware, ransomware, Trojan horses, or any other destructive software.
  • Scanning & Probing: Conducting unauthorised port scans, vulnerability tests, or network monitoring.

3. Email, EDM, & Spam Policy


GoGeeks maintains a zero-tolerance policy for Unsolicited Commercial Email (UCE) and spam. Using our servers or managed Electronic Direct Mail (EDM) systems to send spam heavily damages our network reputation and upstream IP addresses. You must not:

  • Send bulk unsolicited emails or SMS messages.
  • Operate open email relays or open proxies.
  • Harvest email addresses or use lists purchased from third parties without verifiable, opt-in consent.
  • Attempt to disguise the origin of any email transmission or falsify sender routing information.

4. Resource Abuse & Fair Use


Our virtual private servers and cloud infrastructure must be used fairly. Unless specifically permitted in your Service Agreement, you may not use our resources for:

  • Cryptocurrency Mining: Running scripts or nodes to mine Bitcoin, Ethereum, or any other digital currency.
  • Continuous High-Load Processing: Running processes that consume excessive CPU, RAM, or disk I/O to the detriment of other users on shared hardware.
  • Unapproved Proxy Services: Running public proxy servers or VPN nodes that consume massive bandwidth without prior authorisation.

5. Customer Account & Security Responsibilities


You are fully responsible for the activities of anyone who accesses your server, EDM systems, or network using your credentials. To maintain the security of your environment, you must:

  • Maintain Credential Confidentiality: Keep all administrative passwords, API keys, and user access levels strictly confidential. We strongly recommend enabling Multi-Factor Authentication (MFA) on all access points.
  • Secure Hosted Applications: Ensure that any software, CMS, or web applications you host on our infrastructure are actively maintained, patched, and kept up to date.
  • Incident Reporting: Promptly notify GoGeeks if you suspect your environment or credentials have been compromised so we can attempt to mitigate further unauthorised usage.
  • Financial Liability: As explicitly outlined in our Terms & Conditions, you remain strictly liable for all financial charges (including excess bandwidth and bulk SMTP sending fees) incurred if your account is compromised due to weak credentials, user negligence, or failure to maintain adequate security protocols.

6. Monitoring & Enforcement


While GoGeeks does not actively monitor the private content or data hosted on our servers, we reserve the right to investigate suspected violations of this AUP.

If we determine, in our sole discretion, that a violation has occurred, we may take immediate action, which may include:

  • Temporarily suspending your services or EDM sending capabilities.
  • Permanently terminating your account and Service Agreement.
  • Removing or blocking access to offending content.
  • Reporting illegal activities to the relevant Australian authorities and providing them with necessary information.

We will not be liable for any damages or data loss resulting from service suspensions executed under this policy.

7. Amendments to This Policy


GoGeeks reserves the right to modify or amend this AUP at any time. Any updates will be published on this page, and the "Effective Date" will be revised accordingly. Your continued use of our services following any changes constitutes your acceptance of the updated policy.
